Terms of Sale
Article 1 – Purpose
These Terms of Sale govern the sale of products and services offered by EFOIL MAURITIUS LTD, in particular eFoils, accessories, spare parts and demonstration services. Any order implies full and unreserved acceptance of these Terms of Sale.
Article 2 – Products and availability
Products are offered subject to available stock. If a product becomes unavailable after an order has been confirmed, the customer will be informed as soon as possible and may choose:
- an equivalent product;
- a new delivery date;
- a refund of the amounts paid.
Photographs and descriptions of products are provided for guidance only and are not contractually binding.
Article 3 – Prices
Prices are displayed in Mauritian Rupees (MUR) or Euros (EUR) depending on the communication medium. They may be changed at any time without notice. Any delivery costs, taxes or customs duties applicable outside Mauritius remain payable by the customer, unless stated otherwise.
Article 4 – Payment
Accepted payment methods are:
- Bank transfer
- JUICE
- Cash
Payment in full is required before any shipment or handover of equipment. Products remain the property of EFOIL MAURITIUS LTD until full payment has been received. The company reserves the right to refuse an order in the event of non-payment or a prior dispute.
Article 5 – Delivery
Timeframes
Timeframes are given for guidance only.
- Mauritius: generally between 1 and 7 business days depending on availability.
- International: variable depending on the carrier and destination country.
EFOIL MAURITIUS LTD cannot be held liable for delays attributable to the carrier, customs authorities or any case of force majeure.
Receipt
The customer must check the condition of the parcel upon delivery. Any anomaly must be reported immediately to the carrier and to EFOIL MAURITIUS LTD.
Article 6 – Batteries
Lithium batteries are subject to specific regulations regarding their transport. The customer is responsible for ensuring that the chosen mode of transport complies with the regulations applicable in their country.
Article 7 – Demonstrations
Demonstrations are organised subject to favourable weather and safety conditions. EFOIL MAURITIUS LTD may postpone or cancel a demonstration when navigation conditions do not allow the safety of participants to be guaranteed. In the event of cancellation initiated by EFOIL MAURITIUS LTD, a new date or a refund will be offered.
Article 8 – Warranty
PWRFOIL products carry a 2-year legal warranty. The battery and the REVO remote are covered for 2 years or 300 cycles, whichever comes first.
If a defect appears during the warranty period, repairs are carried out by PWRFOIL or by a repairer approved by PWRFOIL. The warranty does not cover, in particular:
- impacts;
- falls;
- improper use;
- disassembly, unauthorised repairs or modifications;
- normal wear and tear, cosmetic defects and scratches;
- use of components not certified by PWRFOIL;
- a battery damaged by a full discharge or by abnormal cycles;
- a damaged or missing certified battery packaging box;
- damage caused by natural disasters or extreme weather conditions;
- an illegible or missing serial number.
Any warranty claim must be accompanied by proof of purchase and the serial number of the component concerned. Get in touch with us: as the approved reseller in Mauritius, we handle the process with PWRFOIL on your behalf.
Article 9 – Liability
EFOIL MAURITIUS LTD cannot be held liable for:
- improper use of the products;
- failure to follow the manufacturer's instructions;
- indirect damages or loss of business;
- delays related to transport or a case of force majeure.
Article 10 – Withdrawal and returns
Returns are accepted within 7 calendar days of receipt of the product, provided that it:
- has never been used;
- is returned in its original packaging;
- is complete and in perfect condition.
Return shipping costs are payable by the customer, except in the event of an error attributable to EFOIL MAURITIUS LTD. No return will be accepted for a used, damaged or incomplete product.
Article 11 – Personal data
Personal data is processed in accordance with our Privacy Policy and the Data Protection Act 2017 of Mauritius.
Article 12 – Applicable law
These Terms of Sale are governed by Mauritian law. Any dispute will be submitted to the competent courts of Mauritius, subject to any mandatory consumer protection provisions applicable in the consumer's country of residence.
